Wellesse All Day Energy “Energize the Natural Way” Sweepstakes

OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. OFFERED ONLY TO LEGAL RESIDENTS OF THE U.S. AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF SWEEPSTAKES ENTRY. VOID WHERE PROHIBITED, TAXED OR RESTRICTED.

1. Promotion Description: Wellesse (“Sponsor”) will award one (1) Grand, fifteen (15) First Place and thirty (30) Second Place Prizes in a random on-line drawing sweepstakes (“Sweepstakes”). Prizes are more completely described below in Rule 5, Description of Prizes.

2. Promotion Period: The Wellesse All Day Energy “Energize the Natural Way” Sweepstakes begins on February 15, 2009 and ends on May 15, 2009 at 11:59:59 pm. All entries must be received during the Promotion Period.

3. How to Enter: To enter to win the sweepstakes go to and follow instructions for entering your information. Participants may enter up to one time per promotion period and up to 3 times in total during the entire promotion. All entries must be completed on-line. Up to five (5) additional entries into the sweepstakes may be awarded each month for sending an “Energize the Natural Way” email to another individual. Additional entries will only be awarded for each unique email recipient entered each month; a total of fifteen (15) additional entries may be awarded for each unique email recipient entered over the course of the promotion. 4. Eligibility: No purchase is necessary to enter or win the Wellesse All Day Energy “Energize the Natural Way” Sweepstakes. Odds of winning will depend on the number of entries received. The sweepstakes offer is open only to legal residents of the U.S. and the District of Columbia who are 18 years of age or older at the time of sweepstakes entry. Entrants may not be employees of the Sponsor or of their parents, subsidiaries, affiliated companies, partners, advertising or promotion agencies, nor may they be members of the immediate families of any of them, or persons living in their households.

5. Description of Prizes: One (1) Grand Prize winner will be awarded a one-year supply (365 bottles) of Wellesse All Day Energy and a personal consultation with nutrition expert Marie Spano. This personal consultation will be conducted by phone. Approximate retail value of the Grand Prize: $1155.00. First Place Prize: Fifteen (15) First Place Prize winners will be awarded a one month supply of All Day Energy, a Wellesse T-shirt and a water bottle. Approximate retail value of the First Prize: $110.00. Second Place Prizes: Thirty (30) Second Place Prize winners will be awarded a two week supply of All Day Energy, and a water bottle. Approximate retail value of the Second Prize: $52.00. Total approximate retail value of all prizes: $4365.00. If prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute the prize with another prize of equal or greater value. Any portion of the prize not accepted by the winner shall be forfeited.

6. Drawing and Awarding of Sweepstakes Prizes: One Grand Prize Winner will be randomly selected from all eligible entries received during the entire Promotion Period. There will be three (3) drawings. Five First Place Prize Winners and ten Second Place Prize Winners will be selected during each promotional period. Winners will be randomly selected from all eligible entries received during the Promotion Period in which they entered. The monthly random drawings will be held on or about March 16, 2009, April 16, 2009 and May 16, 2009. Participants may only win one prize over the duration of the Sweepstakes. The drawings will be done by an independent judging organization whose decisions on all matters regarding this Sweepstakes shall be final and binding. Odds of winning depend on the number of eligible entries received. The Prize Winners will be notified by telephone, email or mail.

The Grand Prize Winner may be required to sign and return within seven (7) days of receipt an Affidavit of Eligibility, a prize release and indemnity agreement and a publicity release, all without additional consideration, if permitted by law. If the Sponsor makes a reasonable attempt to contact the Grand Prize Winner and cannot do so within seven (7) days of the first notification attempt, or if any Winner is found to be ineligible, or has not complied with these Official Rules or returned the Affidavit and/or Releases within the specified time period, that Winner will be disqualified and an alternate Winner may be selected.

If a potential First or Second Place Prize winner is disqualified for any reason, an alternate winner will be selected in a random drawing from among all eligible entries received. Only three (3) alternate winners will be selected. If the alternates are also disqualified for any reason, the applicable prize will not be awarded.

All Prizes will be delivered to Winners by USPS or delivery service.

7. Miscellaneous: The Sweepstakes is governed by the laws in the United States and is void where prohibited. By entering the Sweepstakes, entrants agree to be bound by these Official Rules.

By participating in the Sweepstakes, entrants agree that Sponsor shall have no liability nor shall such parties be responsible for use/misuse of any prize awarded herein and acknowledge that said parties have neither made, nor are in any manner responsible for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes.

Winners also agree to release and hold Releasees harmless from any liability in connection with the Wellesse All Day Energy “Energize the Natural Way” Sweepstakes or any Prize including, without limitation, liability in connection with any injuries, damages or losses of any kind, whether to person or property, including death, arising out of or resulting from, whether directly or indirectly, the acceptance, use or misuse of any Prize. Participants also agree to the use of their names and likenesses by Sponsor for advertising purposes without additional consideration, if permitted by law. Sponsor is not responsible for late, lost or misdirected mail or delivery services.
